1. INTRODUCTION & CORPORATE INFORMATION

This website, evkings.io (the “Site”), and the services provided herein (the “Service”) are owned and operated by INQEMN LTD, a company incorporated under the laws of the Republic of Cyprus with registration number HE 475259, having its registered office at Spyrou Araouzou, No. 201A, Limassol, 3036, Cyprus (the “Company”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms of Service (the “Terms”).

2. DEFINITIONS

For the purposes of these Terms of Service, the following terms shall have the meanings set out below:

• “Account” means the user profile registered on the Site/Platform, including login credentials, subscription status, settings, and any associated data accessible through the Service.
• “Betting Data” means statistical information, bookmaker odds, probabilities, model outputs, indicators, and other analytical data displayed through the Service.
• “Bookmaker” means any third-party sports betting operator or betting platform that offers betting markets, odds, or wagering services to users.
• “Business Day” means any day other than Saturday, Sunday, or public holidays in the Republic of Cyprus on which banks are generally open for business.
• “Company”, “we”, “us”, or “our” has the meaning given in Section 1.
• “Confidential Information” means all proprietary data, outputs, insights, indicators, algorithms, models, methodologies, “betting signals”, materials, and other information provided through the Service that is not publicly available, including any content behind the subscription paywall.
• “EV” or “Expected Value” means a statistical measure used to estimate the theoretical long-term value of a betting opportunity based on probability estimates and available bookmaker odds.
• “Model Output” means any statistical prediction, probability estimate, or analytical indicator generated by EV Kings’ models and displayed through the Service.
• “Partners” means third-party service providers used to operate or support the Service, including data providers, odds providers, infrastructure providers, hosting providers, analytics vendors, and other technology partners.
• “Service” means the services provided via the Site, including the analytics tools, data, mathematical models, statistical outputs, dashboards, and related features offered by EV Kings.
• “Site” means evkings.io and any associated pages, interfaces, or dashboards through which the Service is provided.
• “Subscription” means a paid plan granting a User access to the Service for a defined period (e.g., monthly or annually).
• “Terms” means these Terms of Service, including any policies referenced herein (including the Performance Guarantee Policy).
• “User”, “you”, or “your” means any individual or entity that accesses or uses the Site or Service.

3. NATURE OF SERVICE (NO GAMBLING)

3.1 Analytical Software: EV Kings is a Software-as-a-Service (SaaS) platform providing mathematical modeling, data analytics, and statistical insights. We are not a bookmaker, gambling operator, betting intermediary, or sports betting provider, and we do not accept wagers or facilitate betting transactions.

3.2 No Financial Advice: All data, indicators, and calculations are provided for informational and research purposes only. We do not provide personalized betting, investment, legal, tax, or financial advice. You bear full responsibility for your own betting decisions and financial outcomes.

3.3 No Profit Guarantee: The Service does not guarantee profits or results. Past performance, historical data, or model outputs are not indicative of future outcomes.

4. ELIGIBILITY & PROHIBITED USERS

4.1 Age Restriction: You must be at least 18 years of age (or the legal age for gambling in your jurisdiction) to use the Service.

4.2 Jurisdiction & Lawful Use: You are solely responsible for ensuring that accessing and using the Service is lawful in your jurisdiction. If the Service (or any part of it) is prohibited or restricted where you are located, you must not use it.

4.3 Industry Restrictions: Use of the Service is prohibited for:

• employees, traders, or contractors of any sportsbook or gambling operator;
• employees or owners of competing sports analytics products;
• any entity using the data to train, improve, or develop competing software, datasets, or AI/ML models.

4.4 Sanctions & Restricted Use: You may not use the Service if you are subject to sanctions, located in a sanctioned territory, or if such use would breach applicable laws.

5. ACCOUNTS, SECURITY & USER RESPONSIBILITIES

5.1 Account Registration: You may be required to create an account. You agree to provide accurate, current information and keep it updated.

5.2 Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

5.3 Security Measures: We may make available security features. Where offered, you are responsible for enabling and using such features.

5.4 Suspicious Activity: You must notify us immediately at admin@evkings.io, if you suspect unauthorized use of your account or any security incident.

5.5 One Account / No Sharing: Unless we explicitly permit otherwise, accounts are personal and may not be shared, sold, sublicensed, or transferred.

6. SUBSCRIPTIONS, PAYMENTS & REFUNDS

6.1 Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually).

6.2 Renewals & Cancellation: Your subscription renews automatically unless you cancel before the renewal date. Cancellation stops future renewals; it does not retroactively refund paid fees except where required by law or expressly allowed under these Terms.

6.3 Performance Guarantee & Refunds: Except as expressly provided in our Performance Guarantee Policy (available at [Link to Guarantee Page]), all sales are final and non-refundable. The Company reserves the right to audit all refund claims to ensure compliance with the qualification standards set forth in said Policy.

6.4 Price/Fee Changes: We may change subscription fees from time to time. If a fee change negatively affects you, we will provide reasonable prior notice via the Site and/or email.

6.5 Taxes: Prices may exclude applicable taxes unless stated otherwise. You are responsible for any taxes or duties applicable to your purchase, where required by law.

6.6 Service Interruption: If the Service is unavailable due to technical reasons within our control for more than 12 continuous hours, the user’s subscription period will be extended by two (2) days for every full day of interruption.

7. INTELLECTUAL PROPERTY, LICENSE & CONFIDENTIALITY

7.1 Confidential Information: All data, outputs, insights, indicators, and materials provided behind the subscription paywall are considered the Confidential Information of the Company.

7.2 Limited License: You are granted a limited, personal, non-transferable, non-exclusive, revocable license to access and use the Service for your own internal, personal use.

7.3 Usage Limits / Prohibited Uses: You may not (and may not permit any third party to):

• scrape, crawl, or use automated means to access the Service or extract data;
• republish, resell, sublicense, distribute, broadcast, or share our data or “betting signals” to third parties (e.g., via Discord, Telegram, websites, or paid groups);
• reverse engineer, decompile, disassemble, or attempt to derive source code, models, or methodologies;
• use the Service or data to build, benchmark, train, or improve competing products, datasets, or AI/ML models;
• remove or obscure proprietary notices.

7.4 Enforcement: A breach of this Section will result in immediate termination and/or suspension without refund, and may lead to legal action.

8. ACCEPTABLE USE

8.1 You agree not to use the Service to:

• violate any applicable law or regulation;
• infringe intellectual property, privacy, or other rights;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service, servers, or networks;
• introduce malware, abuse rate limits, or overload systems;
• misrepresent your identity or affiliation;
• encourage or enable others to violate these Terms.

9. DATA DISCLAIMERS, TIMING & THIRD-PARTY ODDS

9.1 “As-Is” Data: The Service is provided on an “as-is” and “as-available” basis. While we strive for accuracy, we do not warrant that the data will be error-free, uninterrupted, or that bookmaker odds will remain available at the time you access them.

9.2 Delays & Market Movement: Data feeds, odds, and calculations may be delayed, incomplete, or affected by latency, rapid market movement, bookmaker updates, or third-party outages.

9.3 Manual Verification: Users must verify all odds and terms with the bookmaker before placing a bet. The Company is not responsible for palpable errors, line changes, stake limitations, voided bets, account restrictions, or bookmaker-specific rules/enforcement.

9.4 Third Parties: Bookmakers, odds providers, data providers, and other third parties are independent from us. We do not control and are not responsible for their acts, omissions, or availability.

10. SUSPENSION & TERMINATION

10.1 Suspension: We may suspend or restrict your account immediately (without prior notice where necessary) if we reasonably suspect: fraud, unauthorized access, security incidents, prohibited use, scraping, redistribution, IP violations, breach of these Terms, legal risk, or harm to the Service or other users.

10.2 Termination: The Company may terminate your access to the Service in the event of a material breach of these Terms, including breaches of Sections 6 or 7. Where reasonably practicable, the Company will provide prior written notice of at least seven (7) days before terminating your access, allowing you the opportunity to remedy the breach. However, in cases involving security risks, fraud, unauthorized use, intellectual property violations, abuse of the Service, or other serious breaches of these Terms, the Company may terminate access immediately and without prior notice.

10.3 Effect of Termination: Upon termination, your license ends immediately and you must stop using the Service and any confidential outputs.

10.4 No Refund: Termination due to breach results in no refund.

10.5 Appeals: You may appeal a suspension or termination decision by contacting admin@evkings.io, and providing relevant details. The Company will review the request and respond within fourteen (14) Business Days, although more complex cases may require additional time.

11. DISCLAIMER OF WARRANTIES & RISK

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Service provides analytical data and insights only, and no outcomes are guaranteed. Any decisions made based on the information provided through the Service are made at your own discretion and risk.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, INQEMN LTD shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including betting losses, lost profits, lost data, or business interruption.

Our total liability shall not exceed the total amount paid by you for the Service during the billing cycle in which the claim arose.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or gross negligence where such limitation is prohibited by law, or limits mandatory consumer rights that cannot be waived.

13. FORCE MAJEURE

We will not be liable for delays or failures caused by events beyond our reasonable control, including outages of hosting providers, internet failures, DDoS/cyberattacks, power failures, natural disasters, war, terrorism, or government actions. We will use commercially reasonable efforts to restore the Service.

14. AMENDMENTS

The Company reserves the right to amend these Terms or the Performance Guarantee Policy at any time. Updated Terms will be posted on the Site and may be communicated via email or in-product notice. Continued use of the Service following changes constitutes acceptance of the new terms.

15. COMPLAINTS & DISPUTES

15.1 Contact First: If you have a complaint, please contact us at admin@evkings.io, with a description of the issue.

15.2 Resolution: We will acknowledge receipt of complaints within a reasonable time and will aim to resolve them within fourteen (14) Business Days of receipt. In cases where the matter is complex or requires additional investigation, resolution may take longer, and the user will be informed accordingly. Nothing in this Section limits any mandatory rights you may have under applicable consumer laws.

16. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms (in whole or in part) to an affiliate or successor in interest in connection with a merger, acquisition, corporate restructuring, or sale of assets.

17. SEVERABILITY & ENTIRE AGREEMENT

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with any policies referenced (including the Performance Guarantee Policy), constitute the entire agreement between you and the Company regarding the Service.

18. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus, without prejudice to any mandatory consumer protection rights that may apply in your country of residence.

19. MISCELLANEOUS

19.1 Waiver: Failure by the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by the Company in writing.

19.2 Third-Party Services: Certain aspects of the Service may rely on third-party providers (including odds providers, data providers, infrastructure or hosting providers, and analytics vendors). The Company shall not be responsible for outages, delays, inaccuracies, or failures caused by such third-party services.

19.3 No Partnership or Agency: Nothing in these Terms shall be construed as creating any partnership, joint venture, employment, or agency relationship between you and the Company.

19.4 Survival: Any provisions which by their nature should survive termination of these Terms, including but not limited to intellectual property rights, confidentiality obligations, limitation of liability, dispute resolution provisions, and payment obligations, shall remain in effect following termination.
